1. Scope, Applicable Law and Place of Jurisdiction
1.1 We, MPB Europe Limited, of 64 Ship Street, Brighton, East Sussex, BN1 1AE, with registration number 06510353 ("we" or "us") operate an online platform for used photo and video cameras including accessories ("Products").
1.2 These Terms and Conditions ("Agreement") govern all contracts entered into via the https://www.mpb.com/en-uk/ online platform ("Platform") between MPB and you as the customer ("Customer", "you") for (i) your purchase of Products that we offer on the Platform ("buy"/"buying"/"bought"/"purchase"); (ii) your offer to sell your Products to us ("sale"/"sell"/"selling"); (iii) the trade of Products, i.e. a combination of a sale to us by you in exchange for your buying from us, which includes financial compensation in the event of a difference in the value of the Products ("trade"), and the use of the Platform by you. Unless expressly regulated otherwise, this agreement applies equally to consumers and traders as defined under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
1.3 The Platform is exclusively aimed at Customers who have reached the age of 18 years.
1.4 All agreements made between you and us in connection with the sale, purchase or trade of Products shall be governed by this Agreement as it stands at the time of the sale, purchase or trade. Customer access to the Platform is also governed by the Privacy Policy and Cookie Policy.
1.5 We do not accept any other terms requested by the Customer. This also applies if we do not expressly object to the inclusion of such terms.
1.6 This Agreement shall be governed by the laws of England. In the event of any dispute in relation to this Agreement or its subject matter, the parties submit to the jurisdiction of the English courts. If you have placed the order as a consumer and have your residence in another country at the time of your order, the application of mandatory legal provisions of this country shall remain unaffected by such choice of law and venue.
2. Registration of a User Account
2.1 You may use the Platform either after registering for a user account or without such registration.
2.2 If you opt to register, you are obliged:
- to provide correct and complete information requested during registration;
- to maintain and update such data so that it remains complete and accurate; and
- to keep your password confidential and carefully secure access to your user account.
2.3 The registration of a user account for a legal entity or partnership may only be carried out by an authorised natural person who must be identified by name.
2.4 We reserve the right to suspend or terminate a user account at any time if we have reason to believe that the information is incomplete or incorrect and/or we deem that the account is being used for purposes other than what it was intended for.
2.5 Your user account is not transferable.
3. Products
3.1 Product Description
3.1.1 The Products offered by us are used products, unless otherwise expressly stated in the respective product description. Used Products may show signs of wear and tear, soiling resulting from previous use, defects or functional restrictions that do not or only slightly restrict normal use, and similar restrictions typical for used Products.
3.1.2 It is our priority that the images of the Products displayed on the Platform are faithful reproductions of the original Products. However, as we do not have full control over the colour reproduction properties of the hardware and software you use to view our Platform, we cannot be held responsible for inaccuracies of the photographs shown on the Platform.
3.1.3 Customers who have questions or need advice on the Products and their use can contact our customer experience team via the Contact Us page.
3.2 Product Availability
3.2.1 We sell the Products which are displayed on the Platform, subject to availability.
3.2.2 We will report on the Platform, in the product detail or at the time you place your order, any permanent or temporary unavailability of our Products.
3.2.3 We reserve the right to change or stop selling the Products on the Platform at any time, and these changes will not affect orders that we have previously accepted.
4. Buy from MPB, Orders, Entry into Contract
This clause applies where you buy a Product from MPB. Provisions for selling your Product to MPB and/or the sell side of trading with MPB can be found in clause 7.
4.1 Placing an Order
Products may be ordered by clicking on the Products you wish to buy and then following the on-screen prompts. You may check and correct any input errors up until you click the "Buy" button on the checkout page. Once submitted, you will not be able to make changes yourself.
4.2 Order Confirmation
4.2.1 As soon as you have placed an order and funds are pre-authorised in accordance with clause 6, we will confirm receipt by an automated email.
4.2.2 The order confirmation does not constitute a binding acceptance of the order by us. The contract for the purchase of the Products is entered into when we confirm acceptance by email or dispatch of the Product, whichever is the later.
4.2.3 You can log into your user account to track your order status or contact our customer experience team if there is a problem.
4.2.4 Sometimes we have to reject an order, for example, because a Product is unexpectedly out of stock, you are located outside our delivery areas, or the Product was mispriced in error. We will let you know as soon as possible and refund any sums you have paid.
4.3 Transfer of Risk, Retention of Title
Risk transfers to you when the Product has been delivered to you or a designated third party. Title passes to you upon full payment of all amounts payable in respect of the Products, including any shipping costs. Until ownership passes, you shall hold the Products as fiduciary agent for MPB.
5. Prices
5.1 All prices stated on the Platform are fixed prices in pounds sterling including any applicable VAT.
5.2 Shipping costs are listed separately in the shopping basket and shown on the order summary before final approval. Additional customs duty for deliveries outside the UK is the responsibility of the Customer.
5.3 We reserve the right not to honour an incorrect advertised price in the event of a publishing error.
5.4 Business customers should note that most used products are sold on the VAT margin scheme, such that there is no VAT applicable to be reclaimed.
6. Terms of Payment when you Buy from MPB
6.1 Payment must be made immediately in pounds sterling at the time of ordering, though only pre-authorisation of funds is made at this stage. Funds will be taken on dispatch. We accept all major credit and debit cards, PayPal, Apple Pay, Google Pay, and sterling bank transfers.
6.2 You guarantee that at the time of confirmation you have all necessary authorisations to use the chosen payment method.
6.3 The order will be processed in accordance with all applicable bank security standards. You must provide the CVV code for anti-fraud verification purposes.
6.4 As part of the ongoing fight against fraud, information about your order may be transmitted to an authorised third party to verify your identity, the validity of the order, the payment method used, and the planned delivery.
6.5 Should you decide to return the Products, MPB will not reimburse you for any tax, import duty, customs duty and/or other charges associated with the import of the Products.
7. Selling to MPB and Trading with MPB, Entry into Contract
This clause applies where you sell your Products to MPB and/or trade with us.
7.1 General Conditions for Your Sale to MPB
You can offer to sell us your used Products which are currently included in the range of Products on our Platform. You must be the rightful owner of the Products offered and have the right to offer the Products for sale or as part of a trade. You are responsible for ensuring that all Products have been legally imported into the United Kingdom.
7.2 Requesting a Quote
Complete the quote form on the Platform to provide information about the Products you wish to sell. MPB uses five cosmetic condition grades:
- Like New: As if brand new out of the box. Little to no sign of wear.
- Excellent: Minor signs of wear to the body or casing.
- Good: Noticeable signs of wear to rubber grips, ports or other components.
- Well Used: Distinct signs of wear and light scuffs. Considerable marks and paint defects may be present.
- Heavily Used: Significant signs of wear, heavy marks or scuffs. Heavy dust, marks and paint defects may be present.
The cosmetic condition specified will have a direct effect on the quote and may be adjusted following physical inspection under clause 7.5.
7.3 Confirmation of Receipt and Quote
We will confirm receipt of the Product information by automated email containing the initial evaluation and a Transaction ID reference number. Such an email quote is not a binding offer by us.
7.4 Delivery of Your Product when Selling to MPB
We will arrange either a courier collection from your address or you can drop the Products at an agreed courier drop-off shop. This service is free for sales to MPB within the UK. MPB accepts no liability for damage or loss of items sent by an alternative service not nominated by MPB.
In the event of loss or damage in transit using the MPB-approved courier service, you must notify MPB within 10 calendar days from the date of dispatch. A full investigation may take up to 30 days. The maximum sum available in the event of a successful claim will be the quoted value.
7.5 Product Review Process
On receipt of the Product, we will carry out a detailed check. If the Products match the cosmetic condition grade in the quote, we will confirm our original evaluation and a contract will be entered into. If the actual cosmetic condition differs from the grade provided, we may offer an adjusted quote. You may accept or reject the adjusted quote. If rejected, we will return the Products to you free of charge. If you accept, the contract is entered into and you can no longer dispute or challenge the adjusted quote.
If we discover that Products have been reported stolen or we suspect they may be stolen, we will immediately notify the police and will not return the item to you.
8. Delivery of Products when you Buy from MPB
8.1 All orders will be dispatched via the nominated courier. MPB shall have no liability for any late delivery however arising. We cannot accept requests to use alternative couriers.
8.2 Orders will be sent to the postal address you provided when placing the order. We endeavour to dispatch Products ordered before 4 p.m. on a working day on the same day.
8.3 Each delivery shall be deemed to have been made when you or a designated third party has physically taken possession of the Product(s) or the Product(s) have been delivered to a "safe" or alternative place.
8.4 If delivery is not made and no suitable alternative agreed, the Products will be returned to the local depot. Products will be returned to MPB after three failed delivery attempts and MPB will process a refund.
8.5 In the unlikely event that your package is lost or the Product has suffered damage, notify MPB within 10 calendar days from the date of dispatch. If marked as delivered but not received, notify MPB within 48 hours. A full investigation may take up to 30 days.
9. Returns Policy when you Buy from MPB
9.1 You may cancel an order at any time before delivery and up to 14 days afterwards, beginning on the day after your order is delivered. You will receive a full refund as soon as possible and, in any case, within 14 days after the day on which we receive the Product(s) back.
9.2 To cancel, email us at [email protected] stating your name and order number, or complete and send the cancellation form. Once confirmed, we will give you a returns authorisation number which must be included with your return.
9.3 The Product must be returned within 14 days of notifying us of cancellation and must be in the same condition in which you received it. You have a legal obligation to take reasonable care of the Product(s) while in your possession.
9.4 Products must be returned via an insured and trackable delivery service. If the return is due to an error on our part, we will arrange for the item to be collected by our nominated courier. In all other cases return postage charges are your responsibility.
9.5 All returns must be accompanied by a copy of the sales invoice clearly showing the returns authorisation number.
9.6 MPB retains the right to issue a refund rather than a replacement on any returned item, including items returned due to faults or where agreed to be not as described.
9.7 Products sold at a discounted or reduced rate will only be eligible for a refund and will not be eligible for a like-for-like replacement.
9.8 All returns of drone equipment are subject to MPB technicians checking the flight log from your drone. All drone warranties are void if the vehicle has been crashed in ATTI mode.
9.9 As part of a Trade, you may return the purchased Product(s) for a refund. We will under no circumstances return to you the original Product(s) which you sold to us once the transaction is completed.
10. Liability
10.1 MPB shall have no liability for any loss or damage to a parcel, or for non-delivery or mis-delivery, if this was due to the negligence or fault of the Customer.
10.2 MPB can under no circumstances whatsoever accept any responsibility for any delay to parcels whilst in transit.
10.3 Nothing in this Agreement shall limit or exclude our liability for: (i) death or personal injury caused by our negligence; (ii) fraudulent misrepresentation; (iii) breach of any term implied by the Consumer Rights Act 2015; (iv) liability under Part I of the Consumer Protection Act 1987; or (v) any other liability that, by law, may not be limited or excluded.
10.4 Subject to the above and to the fullest extent permitted by law, in no event shall we be liable for any indirect or consequential losses, or for any loss of profit, revenue, contracts, data, goodwill or other similar losses. Any liability we have for losses you suffer shall not exceed the purchase price of the relevant Product.
10.5 We will not be liable for any failure to perform or delay in performance of our obligations caused by events outside our reasonable control.
10.6 Nothing within the Agreement shall affect the statutory rights of any consumer.
11. The Warranty on Products which you Buy from MPB
11.1 The warranty period is 12 months for used Products (consumers and traders). The warranty is not transferable. All works carried out under warranty must be pre-approved and authorised by MPB.
11.2 Accidental damage and misuse are NOT covered by this warranty. MPB reserves the right to repair or replace a Product under warranty.
11.4 What is Covered
Parts and labour costs in relation to the repair with an approved repairs agent of any fault which occurred during normal usage of the item within the warranty period. You must contact us for agreement prior to arranging any repair.
11.5 & 11.6 What is NOT Covered
- Consumables, including batteries
- Wear and tear
- Faults caused by shock or fall, sand, dust, dirt, damp or corrosion, leaky batteries, acts of war or terrorism, fire, theft, accidental or malicious damage, water contamination, mould, flooding or other adverse weather conditions
- Accidental damage or misuse
- Faults relating to image sharpness that is clearly open to human judgement
- Faults occurring where parts are no longer produced and the Product cannot be repaired
- Loss of quality due to use of spare parts not recommended by the manufacturer
- Faults due to connection of unapproved accessories
- Faults due to defective repair by someone other than MPB or an MPB-designated repairer
- Lost or damaged data
11.7 Extended Product Protection
If you have purchased Extended Product Protection under XCover Product Protection, please refer to the terms of your Policy in your XCover Account. Product Protection is provided by XCover.com and Cover Genius Limited.
12. Errors and Omissions
We make every effort to provide only correct information on the Platform. Should you find an error, please inform us via the Contact Us page and we will correct it as soon as possible.
13. Personal Data and Effects
13.1 We recommend that you delete or remove ALL personal data stored on a device — such as digital images, private information or contact details — before Products are collected as part of a sale or trade.
13.2 We are not liable for any personal, confidential, private or other information provided to us by customers, whether knowingly or unknowingly, in connection with a purchase or exchange of Products.
13.3 Please ensure that you remove all media storage devices and memory cards before sending your Products to us. Storage media found on receipt will NOT be returned and will be recycled or properly disposed of.
13.4 MPB is not liable for items that are not the subject of the relevant contract but which have been sent to us, whether knowingly or unknowingly.
14. Payments to you on Products which you Sell to MPB
14.1 Payment to you is made via bank transfer (BACS). Once a contract is agreed, you will be contacted to enter a valid sort code and account number through a secure link. For payments to accounts outside the UK, a SWIFT/BIC code, IBAN number, account number and bank address are required.
14.2 It is your responsibility to ensure that the payment details you provide are correct and accurate. MPB will not be liable if you fail to receive a payment as a result of incorrectly provided payment details.
14.3 Failing to provide correct payment details when prompted may result in delays. If you fail to provide correct payment details within 3 months of your item(s) being checked, MPB reserves the right to take ownership of your item(s) without further notification or payment.
14.4 Some payment methods depend on third parties whom we cannot and do not control. We will not be liable for delay in receipt of payment as a result of their actions or inactions.
14.5 In the unlikely event of an overpayment by us, you agree to return the sum overpaid immediately.
15. Force Majeure
MPB will not be liable for any failure to perform our contractual obligations if this is due to circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, acts of God, fire, floods, storms, pandemic, epidemic, forms of industrial action, actions of Internet service providers, and decisions by governments or other authorities.
16. No Text or Data Mining
16.1 You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Platform or any services provided via, or in relation to, the Platform. This includes using any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the Platform or its data, as well as any automated analytical technique aimed at analysing text and data in digital form.
16.2 Clause 16.1 shall not apply insofar as we are unable to exclude or limit such activity by contract under applicable laws.
16.3 Unauthorised use of data on the Platform — including pricing information and the model database — is strictly prohibited.
17. Severability Clause
If one or more provisions of this agreement are found to be invalid in application of a law or regulation or by a final judgement of a competent court or authority, the remaining provisions shall remain fully effective.

19. Right to Refuse Service
We reserve the right to refuse service to any customer who exhibits abusive, rude, or harassing behaviour towards our employees. This includes, but is not limited to, verbal abuse, threats, and any form of harassment. Maintaining a safe and respectful environment for our employees is of utmost importance to MPB.
